Welcome to the TailsDate App (“App”), a platform designed for pet owners to connect, share photos and videos of their pets and themselves, engage through likes and virtual gifts (Stars), become friends, chat, and arrange meetups. These Terms and Conditions (“Terms”) govern your access to and use of the App, operated by 8PM-ART Productions LLC, in the United States, United Kingdom, and European Union. By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. These Terms apply to all users, including free users, subscribers, moderators, and administrators. We may update these Terms periodically, and continued use of the App after changes constitutes acceptance of the updated Terms.

2. Eligibility

To use the App, you must:

• Be at least 13 years old to comply with the U.S. Children’s Online Privacy Protection Act (COPPA) and applicable EU/UK data protection laws (e.g., GDPR). Users under 18 require parental consent.
• Reside in the United States, United Kingdom, or European Union.
• Provide accurate and complete information during registration.
• Not be prohibited from using the App under applicable laws.

3. Account Registration and Management

3.1 Account Creation

To access the App’s features, you must create an account by providing accurate information, including your name, email address, and optional location data. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.2 Profile Management

Users may upload photos, videos, and other content to personalize their profiles. You represent and warrant that all content you upload complies with these Terms and does not infringe on any third-party rights.

3.3 Account Deletion

You may delete your account at any time through the App’s settings, in compliance with Apple’s App Store Guidelines. Account deletion is permanent and will remove all associated data, including profiles, posts, and Stars history, subject to applicable laws.

3.4 Two-Factor Authentication

For enhanced security, you may enable two-factor authentication (2FA). You are responsible for ensuring your contact information is up-to-date to receive 2FA codes.

4. App Features and Usage

4.1 User Features

• Profile Management: Create and edit profiles with photos, videos, and location-based features.
• Feed Interaction: Like, save, report, or share posts. Sharing uses Branch.io to direct non-users to download the App from the Apple App Store or Google Play Store.
• Friends Module: Send and receive friend requests, view nearby users, search for users, and block or report inappropriate users.
• Chat Module: Communicate with accepted friends via text-based messages with timestamps, read/unread counts, and paginated chat history.
• Multilingual Support: Switch between English, Spanish, German, and French for the App interface.

4.2 Subscription-Based Features

Premium features, such as advanced search and profile visibility, are available through subscription plans:

• Silver: 1-month plan
• Gold: 3-month plan
• Platinum: 1-year plan

You may upgrade, renew, or cancel subscriptions through the App. Subscription fees are non-refundable, except as required by law.

Free Trial for New Users: As a promotional offer for new users, we provide a 30-day free trial of premium features, including access to the interactive feed, enhanced profile visibility, creation of up to 5 pet profiles, send/receive friend requests, advanced friend search tool, access to private messenger, and monthly virtual star payouts. No credit card is required to start the trial. At the end of the 30-day trial period, your subscription will automatically renew to the Silver plan (or the plan you selected during signup) at the then-current rate unless you cancel before the trial ends. You can cancel auto-renewal at any time through your App Store or Google Play account settings. If you cancel during the trial, you will retain access until the end of the 30-day period, but no further charges will apply. This trial is available once per user and may be subject to change or discontinuation at our discretion. For full details, refer to your App Store or Google Play subscription management. For GDPR compliance, you may withdraw consent for auto-renewal by contacting support@tailsdate.com, which will end trial access immediately.

4.3 Gifting and In-App Purchases

• Stars: Users may purchase and gift Stars (virtual gifts) to posts. Stars are deducted from the sender’s account and credited to the recipient’s account.
• Payouts: Subscribers may convert earned Stars into monetary payouts, processed monthly via Stripe or PayPal, subject to applicable fees and taxes.
• Star History: Users can view their Stars transaction history under their profile or for specific posts.

5. Payments and Payouts

5.1 In-App Purchases

All payments for subscriptions and Stars are processed through third-party providers (Stripe or PayPal) via the Apple App Store or Google Play Store. You are responsible for any taxes or fees associated with your purchases.

5.2 Payouts for Stars

Subscribers may request payouts for earned Stars once per month. Payouts are subject to verification and processing fees. 8PM-ART Productions LLC is not responsible for delays caused by third-party payment providers.

5.3 Refunds

In-app purchases and subscriptions are non-refundable, except as required by applicable consumer protection laws in the USA, UK, or EU.

6. Content and Conduct

6.1 User Content

You retain ownership of the content you upload (e.g., photos, videos, bios) but grant 8PM-ART Productions LLC a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content for the purpose of operating and promoting the App. You are responsible for ensuring your content:

• Does not violate intellectual property, privacy, or other rights.
• Is not obscene, defamatory, harmful, or sexually explicit.
• Complies with our Community Guidelines.

Image and Copyright Compliance: You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to upload any images, photos, or videos (including those depicting pets or individuals) to the App. You must not upload any content that infringes third-party copyrights, trademarks, or other intellectual property rights. Unauthorized use of copyrighted material, such as stock images, celebrity photos, or content from other sources without permission, is strictly prohibited. You agree to indemnify and hold harmless 8PM-ART Productions LLC from any claims, damages, or liabilities arising from your infringement of third-party rights.

Prohibition on Sexual or Pornographic Material: You expressly agree not to post, upload, or share any sexual or pornographic material, including images, videos, or text that depict nudity, explicit sexual content, cruelty to animals, or material deemed inappropriate for a general audience. Such content will be removed, and your account may be suspended or terminated.

6.2 Content Moderation

Moderators and administrators may review and remove content that violates these Terms or Community Guidelines, including sexual, pornographic material, cruelty to animals, or copyright-infringing content. Users may report inappropriate content or behavior for review.

6.3 Prohibited Conduct

You agree not to:

• Post or share illegal, harmful, offensive, or sexually explicit content, including pornographic material or copyrighted images without rights.
• Use the App to harass, bully, or discriminate against others.
• Attempt to bypass security measures or access unauthorized features.
• Use the App for commercial purposes without prior approval from 8PM-ART Productions LLC.

6.4 Copyright Infringement Reporting

If you believe your copyrighted work has been used on the App without authorization, please notify us via email at support@tailsdate.com with the following details (in compliance with the U.S. Digital Millennium Copyright Act (DMCA) and equivalent laws in the UK/EU):

• Identification of the copyrighted work claimed to be infringed.
• Identification of the allegedly infringing material and its location.
• Your contact information (name, address, email, phone).
• A statement that the information is accurate and you are the copyright owner or authorized to act on their behalf.
• A statement under penalty of perjury that the notice is accurate and in good faith.

Upon receiving a valid notice, we will promptly remove or disable access to the infringing material and notify the user. Repeat infringers may have their accounts terminated. We reserve the right to forward notices to law enforcement if warranted.

7. Privacy and Security

7.1 Data Protection

We prioritize your privacy and use encryption protocols to secure your data. Our Privacy Policy details how we collect, use, and protect your information, in compliance with COPPA, GDPR, and other applicable laws.

7.2 Location-Based Features

If you enable location services, the App may use your location to suggest nearby users or content. You can disable location services at any time.

7.3 Third-Party Services

The App integrates third-party services (e.g., Stripe, PayPal, Branch.io) for payments and sharing. These services have their own terms and privacy policies, which you should review.

8. Notifications

You may receive push notifications for likes, comments, messages, new content, or engagement reminders. You can manage notification preferences in the App settings.

9. Intellectual Property

All source code, designs, and content created by the App are the exclusive property of 8PM-ART Productions LLC. You may not copy, modify, or distribute any part of the App without prior written consent.

10. Termination

We may suspend or terminate your account for violating these Terms, including posting sexual, pornographic material, cruelty to animals, copyright infringement, engaging in prohibited conduct, or at our discretion. Upon termination, your access to the App and its features will cease, and earned Stars may be forfeited if not paid out prior to termination.

11. Limitation of Liability

To the fullest extent permitted by law, 8PM-ART Productions LLC and its affiliates are not liable for any indirect, incidental, or consequential damages arising from your use of the App. The App is provided “as is” without warranties of any kind.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, United Kingdom, and European Union, depending on your location. Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (for USA users), the London Court of International Arbitration (for UK users), or the European Court of Arbitration (for EU users), unless otherwise required by law.

13. Multilingual Support

The App supports English, Spanish, German, and French. These Terms are provided in English, but translations may be available for convenience. In case of discrepancies, the English version prevails.
